(02-05) 14:03 PST SAN FRANCISCO -- The prosecution's perjury case against Barry Bonds ran into trouble today when a federal judge questioned the admissibility of much of the evidence that the former Giants star had tested positive for steroids.

U.S. District Judge Susan Illston did not issue a ruling after a 90-minute hearing in San Francisco. But she said she was inclined to exclude evidence of blood and urine test results, laboratory records and steroid-use calendars unless prosecutors have a witness with first-hand knowledge to connect those items to Bonds.

That witness would be Greg Anderson, Bonds' former trainer, who has already spent more than a year in jail for refusing to testify against his longtime friend, baseball's all-time home run leader. Anderson is free now but could be imprisoned again if he declines to testify at Bonds' trial.

The government says the recording was made in the Giants clubhouse by Steve Hoskins, then Bonds' friend and business manager. He hoped to play it for Bonds' father, former Giants outfielder Bobby Bonds, in hopes of convincing him that his son was using steroids and to get Barry Bonds to stop, prosecutors said.

Some of Anderson's taped statements referred to illegal drugs and might incriminate him, Illston said. While hearsay is usually considered too unreliable to be presented in court, self-incriminating statements are an exception, on the grounds that the speakers wouldn't make such admissions unless they believed they were true.

Illston may also allow prosecutors to present evidence of a test conducted in 2003 by Major League Baseball that allegedly showed Bonds had used the designer steroid THG, known as "the clear," and another drug intended to hide it, after a retest in 2004.

The difference between the private tests and the one taken in 2003 is that prosecutors have no need for Anderson to authenticate that Bonds supplied the sample to Major League Baseball. Without Anderson's testimony, however, there may be no direct evidence that the 2000 and 2001 samples were provided by Bonds.
